Terms of Service
These Terms of Service ("Terms") govern your use of Aeluka Sheets ("Aeluka Sheets", "we", "us", or "our") and the service at sheets.aeluka.com (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Acceptance of these terms
By accessing or using the Service, you confirm that you can form a binding agreement and that you agree to these Terms and to our Privacy Policy and Billing and Refund Terms. If you use the Service on behalf of an organization, you confirm you are authorized to accept these Terms for that organization.
Description of the service
Aeluka Sheets lets an account owner turn a spreadsheet into a field data collection tool. An owner can build or import a spreadsheet, share a Magic Link with field reps who submit data and optional photos without an account, have that data land in the owner's spreadsheet, and optionally run AI verification of uploaded photos against the typed values. We may add, change, or remove features over time.
Accounts and responsibilities
You are responsible for your account and for all activity that happens under it. You agree to provide accurate account information, to keep your login credentials secure, and to notify us at contact@aeluka.com if you believe your account has been accessed without your permission. Owner authentication is provided through Clerk. Field reps do not need an account; they submit data through the Magic Links you share.
Your data and Magic Links
You are responsible for the lawfulness of the data you collect through the Service, including data collected from field reps and any other individuals through your Magic Links. You represent that you have the necessary right, legal basis, or consent to collect that data and to have us process it on your behalf. As described in our Privacy Policy, for data you collect through your forms you are the controller of that data and we process it on your behalf.
Acceptable use
You agree not to use the Service to:
- Break any law or regulation, or infringe anyone's rights.
- Collect data you do not have the right or consent to collect, or collect data about people who have not agreed to provide it where their agreement is required.
- Upload or transmit malware, or attempt to gain unauthorized access to the Service or its systems.
- Interfere with, overload, or disrupt the Service, including through automated abuse of Magic Links or the submission endpoints.
- Reverse engineer, copy, or resell the Service except to the extent this restriction is not permitted by law.
- Use the Service to store or share unlawful, harmful, or abusive content.
- Misrepresent your identity or impersonate any person or organization.
We may investigate and take action, including suspension, if we reasonably believe you have violated these Terms.
Intellectual property
Aeluka Sheets and all software, design, and branding that make up the Service are owned by us and are protected by applicable intellectual property laws. These Terms do not transfer any ownership of the Service to you.
You keep ownership of your own content, including the spreadsheets you create and the data you collect. You grant us only the limited permission needed to host, store, process, and display that content in order to provide the Service to you, including running the features you enable, such as AI photo verification.
Third-party services
The Service depends on third-party providers, including Clerk for authentication, Neon for database storage, Cloudflare for photo storage and hosting, Dodo Payments for payments, and Google's Gemini API for AI photo verification. Their availability, performance, and terms are outside our control. We are not responsible for the acts, omissions, or downtime of these providers, though we will make reasonable efforts to keep the Service working.
Plans and billing
Some features require a paid subscription. Plans, renewal, cancellation, and refunds are described in our Billing and Refund Terms, which form part of these Terms.
Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error free, or secure, or that AI photo verification verdicts will be accurate. Verification verdicts are an aid for your review and are not a guarantee about any photo or value.
Limitation of liability
To the maximum extent permitted by applicable law, Aeluka Sheets will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of the Service. To the maximum extent permitted by applicable law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Aeluka Sheets from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your misuse of the Service, your violation of these Terms, or your collection or use of data without the right or consent to do so.
Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required to protect the Service or other users, or if required by law. On termination, your right to use the Service ends. Where practical, you will be able to export your content before your account is closed, and sections of these Terms that by their nature should survive, such as intellectual property, disclaimers, limitation of liability, and indemnification, will continue to apply.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after an update takes effect means you accept the updated Terms.
